Driving is a actually a bit different since it's a privilege. You can be compelled to give a blood test or other sobriety test or lose your license.I wouldn't be surprised if there's case law around the smell of non-alcoholic beer on a driver.

That's how alcohol breathalysers work here - if it looks like you're over the legal limit you get a second, more sophisticated test.If you're way over whatever limit they decide for THC then it shouldn't matter if you have a prescription - a medical need doesn't make you a better driver while under the influence.But I agree with what you're saying - it's not the tool that is problematic here, but the laws that go around it. The devices can be good at determining if alcohol is in the blood. Maybe they aren't exact. But they can help keep drunk driving from being so dangerous.Of course a particular person may perform better when drunk. The law just sets a number (0.02? 0.08 would be dead drunk in any state in the US) which doesn't prove a person is impaired or not. It just lets lawyers argue.

The test is trivial - take a breathalyzer and compare results after say 2, 3, 5 beers before and after. Some mental / IQ test could be added to make sure we don't have folks driving around passing breath test while being very drunk.Something tells me if they can't provide such a trivial result, it ain't working as folks expect (and god knows what nasty side effects it can have).
