They get sued if they knowingly sell a defective product.
Legally I believe that's an issue between the consumer and the merchant and/or manufacturer.
The US company is liable because they're the ones selling to end users.
You should care about a seller who sells products with known flaws.
Sounds like a reason the retailer should either work it out with, or sue, the manufacturer.
