It's not up to Github to challenge them. It's up to the person(s) responsible for the "violation". In this case, Github is just the messenger (AIUI).

Wouldn't this also make Github illegal?

Github is likely to be actively cooperating. They normally seek to remove such content; it's against the terms of service.
